Public offer / service agreement

“Service” means the Spinnify SaaS platform and related components (dashboard, widget script, and viewer delivery). “User” means an individual or entity that uses the Service. “Content” means any files, images, frame sequences, product metadata, and other materials uploaded by the User.

We provide the User with access to the Service under the selected plan and make available tools to upload and publish 360° product views and related widget functionality. The Service is provided remotely via the website and APIs where applicable.

You must provide accurate account details and keep credentials secure. You are responsible for all activities under your account. We may suspend or terminate access if we reasonably believe the account is used in violation of these terms or applicable law.

Paid access is offered as a subscription unless stated otherwise. Payments are processed by Stripe. By purchasing a subscription, you authorize recurring charges according to the selected billing period. Prices may be shown excluding or including taxes depending on jurisdiction; applicable taxes (e.g., VAT) may be added at checkout. If a payment fails, we may retry charges and/or suspend paid features after a grace period.

We may offer a free demo or trial tier. Plan limits (e.g., number of active items, storage, bandwidth, or feature availability) are defined in-product and may differ by plan. Exceeding plan limits may require an upgrade or may restrict certain functionality.

You retain ownership of your Content. You grant us a limited license to host, process, optimize, and deliver Content solely to provide the Service (including generating optimized formats and serving viewer frames through our delivery infrastructure). You represent that you have the rights necessary to upload the Content and to grant these permissions.

You agree not to misuse the Service, including attempting unauthorized access, interfering with stability, uploading unlawful content, distributing malware, or violating intellectual property rights. We may remove or restrict access to content or accounts that violate these terms.

The Service is provided on an “as is” and “as available” basis. We may modify features, plans, or technical implementation over time. We may perform maintenance that may temporarily reduce availability, and we may discontinue parts of the Service with reasonable notice where practical.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid for the Service in the 3 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Our processing of personal data and use of cookies is described in our Privacy Policy and Cookie Policy. By using the Service, you acknowledge those policies.

This Offer and any agreement formed by accepting it are governed by the laws applicable to the Service operator as indicated on the Contact page, unless mandatory law requires otherwise. Disputes should first be attempted to be resolved by contacting support; if unresolved, disputes are handled in the competent courts as determined by applicable law.
